Bws Agreement 2020

Adero Law is investigating the underpayments of BWS and Dan Murphy employees who worked at Liquor stores in Woolworths and ALH between August 2014 and February 2020. We accept expressions of interest. Company agreements are agreements concluded at company level which lay down the minimum working conditions applicable to a group of workers and to an employer. The Shop, Distributive and Allied Employees Association (SDA) and supermarket chain Woolworths agreed on employee pay increases and later withdrew a lawsuit. Company agreements are based on the minimum conditions of the Modern Awards and/or vary. Modern awards are a safety net of minimum conditions for an entire industry or job, for example the General Retail Industry Award 2010 applies to retail. If a job has a company agreement, the modern price does not apply. Company agreements and bonuses apply in conjunction with National Employment Standards (“NES”). The NES applies to all employees (with the exception of staff of the Land Government and municipal councils) and they cannot be superseded by an arbitration award or agreement. Vote on proposed deal takes place online under www.eavote.com.au The disagreements stem from an unusual decision by the Fair Work Commission to postpone until February next year a July 1 annual wage increase set in company agreements (EAs) for woolworths supermarkets, Big W, BWS and Dan Murphy`s brands.

The proposed agreement introduces provisions on shiftwork. Team members must be specifically hired by BWS as shiftworkers. No current team members are hired as shiftworkers. Current team members can only become shiftworkers by mutual agreement. Shiftworkers benefit from different penalties and their working time is limited, so a shift must start after 6 p.m., but before 5 a.m. the next day. The current agreement has 2 classifications, Level 1 Sales Assistant (100%) and Level 2 Senior Sales Assistant (105%). The proposed agreement introduced a new classification (Retail Employee Level 2 – Team Member Ride-on equipment).

The current Level 2 classification corresponds to Level 3 of the proposed agreement. The theory of relativity for level 3 classification is moved from 105% of level 1 (currently) to 104% of level 1 on July 1, 2020.
